Arizona Law to Take Effect in 2026 Aims to Reduce Marijuana Promotion to Minors

A new law in Arizona, set to take effect in 2026, aims to curb the promotion of marijuana to minors by regulating how licensed marijuana establishments can advertise their products. The law, signed by Governor Katie Hobbs, targets advertisements that appeal to individuals under the age of 21.

The legislation, sponsored by Rep. Selina Bliss, prohibits the use of images or likenesses of toys, cartoons, or fictional characters, including Santa Claus, in marijuana advertisements. Additionally, it bans the use of names or branding that resembles or imitates food or drink products marketed to children.

The law also restricts advertising in certain public areas, including airports, public buses and trains, and shelters at bus stops. Online advertisements are allowed, but only if at least 73.6% of the expected audience is 21 years old or older. This threshold is based on Census Bureau data and is also used by the Distilled Spirits Council of the United States to determine whether advertising is targeted at adults or children.

Other restrictions include a ban on sponsoring sporting events unless at least 73.6% of the audience is expected to be 21 years old or older. Billboards within 1,000 feet of child care centers, churches, substance abuse recovery facilities, public parks, or schools are also prohibited.

The law’s goal is to protect children from being targeted by marijuana advertisements, according to Bliss. She cited her own experiences as a nurse in the ER and ICU, where she has seen the devastating effects of accidental marijuana poisonings on children.

The law is not a new concept, as it is modeled after the Federal Trade Commission’s efforts to crack down on tobacco advertising that targeted children. A pediatrician, Gary Kirkilas, testified in favor of the bill, citing the need to set similar restrictions on the sale of marijuana.

The law will take effect on June 30, 2026, giving businesses time to come into compliance. While some may still find ways to promote marijuana to minors, the law aims to reduce the appeal of marijuana to young people and promote responsible advertising practices.
