Nebraska Medical Cannabis Legalization Lawsuit Dismissed

A Nebraska district court has dismissed a lawsuit filed last year aimed at blocking the legalization of medical marijuana in the state. The lawsuit, brought by former State Senator John Kuehn, claimed that the ballot measures legalizing medical marijuana violated state and federal law. However, a Lancaster County judge ruled that the plaintiff lacked standing to sue.

The decision comes as the Nebraska Medical Cannabis Commission has adopted temporary regulations for the industry. The commission has also reached agreements with two state entities to establish official rules for the medical cannabis industry.

In November, Nebraska voters overwhelmingly supported the legalization of medical marijuana, with 70% of voters casting “yes” votes. The adoption of emergency regulations marks a significant step forward in implementing the new law.

The dismissal of the lawsuit brings an end to the legal challenge and clears the way for the state to move forward with implementing its medical cannabis program.
