Florida Marijuana Legalization Measure Sues State Officials Over Ballot Access

Florida Marijuana Legalization Measure Sues State Officials

A campaign to legalize recreational marijuana in Florida has taken legal action against Governor Ron DeSantis’ administration, accusing state election officials of attempting to block the measure from appearing on the 2026 ballot. Smart & Safe Florida, the group behind the initiative, filed a petition with the Florida Supreme Court, alleging that state officials have failed to confirm the group’s collection of hundreds of thousands of voter signatures required to qualify for the ballot.

The group claims to have gathered more than three times the necessary number of signatures, but state election officials have yet to formally verify the milestone. According to Florida law, the official confirmation is a procedural requirement that must be met before the proposed amendment can be reviewed by the state attorney general and ultimately the state Supreme Court.

This latest development marks a significant escalation in the ongoing conflict between progressive organizers and Governor DeSantis, who has previously used state resources and his political influence to oppose efforts to legalize marijuana and expand abortion rights. The dispute has been ongoing for years, with the Smart & Safe Florida campaign seeking to amend the state’s constitution to allow for the recreational use of marijuana.
