Nebraska Governor Jim Pillen Has Signed Off on Medical Cannabis Regulations
Governor Jim Pillen has officially approved the medical cannabis regulations proposed by the Nebraska Medical Cannabis Commission. The regulations, which will take effect on Monday, were previously reviewed by Nebraska Attorney General Mike Hilgers, who deemed them constitutional and legally valid.
The regulations, which were set to expire on July 15, will now replace the temporary regulations that were in place. The new regulations will govern the state’s medical cannabis program, which was approved by voters in December 2024.
Some of the key requirements in the regulations include:
* Establishing a directory of “Recommending Health Care Practitioners” and requiring patients to obtain a recommendation from one of these providers in order to access Nebraska-licensed dispensaries.
* Restricting purchases of medical cannabis to no more than 5 ounces in a 30-day period, with no more than 5 grams of delta-9 THC from the same dispensary.
* Allowing no more than 12 medical cannabis dispensaries statewide, with one dispensary per judicial district.
* Prohibiting the sale of smoking or vaping products and edibles, with the exception of oral tablets with a thin layer of flavoring.
The regulations were revised after Governor Pillen initially rejected a previous draft in September, citing a lack of plant limits for licensed cultivators. The commission subsequently added a plant limit of 1,250 flowering plants per cultivator, which was approved by Pillen.
The Medical Cannabis Commission is set to meet again on July 20.
