Mississippi’s Marijuana Landscape: A Complex Mix of Decriminalization and Regulation

Recreational Marijuana in the US: Where Does Mississippi Stand?

In the United States, 24 states have legalized recreational marijuana, allowing adults to buy and consume cannabis for non-medical use. However, Mississippi is not one of them. While it’s not fully legal, the state has partially decriminalized marijuana, making it possible to possess small amounts without facing criminal charges.

According to NORML, a nonprofit organization advocating for the legalization of marijuana, possessing 30 grams or less of cannabis might result in a fine of $100 to $250. For a second offense, the fine can increase to $250, and a misdemeanor charge may be issued, carrying a sentence of five to 60 days in jail.

Hash and concentrates have stricter penalties, with possessing 0.1 grams or less punishable by up to a year in jail and a fine of up to $1,000. Driving under the influence of marijuana is also a misdemeanor, with a fine of up to $1,000 and 90 days in jail.

Mississippi has a more complex system when it comes to medical marijuana. While it’s legal for medical use, patients must obtain a prescription card from a state-registered doctor, which can be used to purchase cannabis products from licensed dispensaries. The state allows patients to purchase up to six Medical Cannabis Equivalency Units (MCEUs) per week, with one MCEU equivalent to 3.5 grams of flower, 1 gram of THC concentrates, or 100 milligrams of THC in an infused product.

Growing marijuana at home is not legal in Mississippi, and even medical marijuana patients are not permitted to cultivate their own cannabis. The state regulates licensed facilities that cultivate cannabis for medical use or production.

In a recent legislative session, Mississippi lawmakers avoided passing a ban on hemp products, allowing the sale of drinks with low levels of THC. Intoxicating hemp products will remain available for purchase, with no age restriction.

In summary, while Mississippi has not legalized recreational marijuana, it has partially decriminalized the drug, making it possible to possess small amounts without facing criminal charges. Medical marijuana is legal, but patients must obtain a prescription card and purchase products from licensed dispensaries. Growing marijuana at home is not permitted, and intoxicating hemp products are available for purchase.
