Nebraska Medical Cannabis Commission Moves Forward with Regulations and Licensing

The Nebraska Medical Cannabis Commission held a meeting on April 13, during which they approved emergency regulations and the final cultivator license. However, manufacturers are still in the dark about when they will be able to apply for licenses, as no timeline has been set for applications or the application process.

The commission also discussed the need to hire an executive director and additional staff, following approval from the state Legislature. Furthermore, they approved a motion to seek outside legal counsel to distance themselves from the Nebraska Attorney General’s office and avoid any appearance of conflict of interest.

Despite these developments, medical cannabis advocates are concerned that doctors may not recommend medical cannabis due to a lack of protections in place. Bill Hawkins, a medical cannabis advocate, pointed out that Nebraska physicians are unable to recommend medical cannabis without fear of losing their license through the Health and Human Services.

Interim Chairwoman Lorelle Mueting stated that the commission has no plan to seek a memorandum of understanding with the attorney general’s office or address the issue themselves. Instead, they will move forward with the current process and address the topic if necessary.

The commission’s next meeting is scheduled for May 11 at 1 p.m.
