Texas Lawmakers and Industry Leaders Embrace Cannabis Regulation Amidst Ongoing Flux
In a significant shift, lawmakers and industry leaders in Texas have acknowledged that cannabis is here to stay, following the failed attempt to ban consumable hemp products. However, the challenge of regulating the market remains a pressing issue that will likely be addressed in 2027.
State Senator Nathan Johnson and Representative Drew Darby, who spoke at the Texas Cannabis Policy Conference, expressed their commitment to finding a safe and responsible way to regulate businesses that sell THC products, rather than pursuing prohibition. Darby noted that the issue is currently in a state of flux, and lawmakers must take action to address the uncertainty.
Industry leaders, including Heather Fazio, director of the Texas Cannabis Policy Center, believe that Texas is on track to provide safe and legal access to cannabis for responsible adult use and to expand access for patients who benefit from the compassionate use program.
The Texas Alcoholic Beverage Commission and the Department of State Health Services are working together to develop industry rules and regulations, but the proposed guidelines have drawn criticism from some stakeholders. Todd Harris, co-owner of The Happy Cactus Apothecary in Austin, expressed concerns that the proposed rules would shutter small businesses through over-regulation and high licensing fees.
Lawmakers acknowledged that the inability of the House and Senate to reach a compromise has led to the agencies taking the lead on regulation. However, Senator Johnson emphasized the importance of legislative involvement, as lawmakers have more time to hear from different views and make informed decisions.
The fate of the ban on consumable hemp products remains uncertain, with Governor Greg Abbott having vetoed the ban and Lt. Governor Dan Patrick continuing to push for a ban. Senator Johnson believes that Patrick will continue to prioritize the ban in 2027, but the House is unlikely to support it.
As the regulatory landscape continues to evolve, industry leaders and lawmakers are working together to find a solution that balances the need for regulation with the need for access to cannabis products.
