Nebraska Judge Dismisses Part of Lawsuit Against Medical Marijuana Ballot Initiatives
A Lancaster County District Court judge has ruled that parts of a lawsuit against two medical marijuana ballot initiatives will be dismissed. The lawsuit, filed by former state senator John Kuehn, claimed that the initiatives did not meet the necessary requirements to be on the November ballot.
Judge Susan Strong dismissed two of Kuehn’s claims, including that the petition lacked a legally sufficient sponsor statement and that it violated the state’s single subject rule. However, the judge will still hear arguments regarding the validity of the signatures collected and allegations of fraudulent signatures.
As a result, both initiatives dealing with medical cannabis will remain on the November ballot. Crista Eggers, spokesperson for Nebraskans for Medical Marijuana, welcomed the decision, stating that the organization will continue to fight for the right to appear on the ballot. The group is confident that their campaign met all legal requirements and is focused on educating supporters and encouraging them to vote in favor of the initiatives.
The ruling comes as a boost to the medical marijuana campaign, which has been gaining momentum in the state. With the initiatives set to remain on the ballot, voters will have the opportunity to weigh in on the issue in November.
